What to Expect After Being Accused of Assault in Colorado

If you’ve been accused of assault, it’s important that you know to what degree you’re being charged. There are three types of assault, first, second, and third-degree.
  • 1st Degree: First-degree assault is a felony. If you’re being accused of first-degree assault, you’re being accused of having caused severe bodily injury to someone using a deadly weapon, knowingly engaged in deadly or seriously harmful actions, intentionally causing disfigurement of another person, or threatening a police officer or firefighter with a weapon with intent to harm. 
  • 2nd Degree: While not as serious as first-degree assault, being accused of second-degree assault can still mean facing serious consequences since it’s also considered a felony charge. Second-degree charges are brought on by similar actions to first-degree assault, but also include exposing a detention facility employee to any kind of body fluid with the intent to cause bodily harm. 
  • 3rd Degree: Third-degree assault is Colorado’s least serious assault charge. It’s considered a class 1 misdemeanor and is typically associated with bar fights or other physical altercations that don’t end in severe bodily harm. 
These different types of charges will bring on their own consequences, and without the proper legal defense, your penalties can wreak havoc on your life.

Harassment in Colorado

Harassment is considered a class 2 misdemeanor, or a class 1 if it involves physical contact in Colorado. You could be charged with harassment if you do any of the following with the intent of annoying, alarming, or harassing another person:
  • Subject another individual to unwanted or unprovoked physical contact
  • Direct obscene gestures of language to another person in a public place 
  • Follow a person in or around a public place
  • Continue to communicate with a person even though they’ve made it clear that they don’t wish to have contact with
  • Continue to insult, taunt, challenge, or communicate aggressively 
If accused of harassment, you could be facing petty offense or misdemeanor charges. However, in Colorado, harassment of another person due to their race, religion, or disability could result in up to a year in jail and a $1,000 fine.
