Some Colorado statutes indicate that jail is mandatory in certain situations. For instance, if you are convicted of DUI or DWAI and have a prior conviction for an alcohol driving offense, you could be facing a sentence of a minimum 10 days up to 60 days, or having felony charges filed. Also, for first offenders where the breath or blood test is .20 or higher within 2 hours of driving, you will also face a mandatory sentence of 10 days.
